Terms and conditions
By placing an order for custom surfboards or any other services offered by Lightwave Surfboards, you acknowledge that you have read, understood, and agreed to these terms and conditions.1. Manufacturing Services

1.1 Lightwave Surfboards will provide manufacturing services for custom surfboards as requested by the customer.
1.2 The manufacturing process will begin upon receipt of the customer's order and payment (non-refundable) of the deposit, unless otherwise agreed upon in writing.
1.3 Lightwave Surfboards reserves the right to refuse any order that it deems inappropriate, illegal, or in violation of any intellectual property rights.
1.4 The manufacturing timeline provided by Lightwave Surfboards is an estimate and may be subject to change due to unforeseen circumstances or delays beyond our control. Lightwave Surfboards will make reasonable efforts to keep the customer informed of any significant delays.
2. Pricing and Payments

2.1 The prices for manufacturing services are stated in New Zealand dollars and are exclusive of any applicable taxes, shipping costs, duties, or customs fees.
2.2 The customer agrees to pay the total amount specified at the time of order placement, including any additional charges for customisation and shipping.
2.3 Payments can be made via authorised credit/debit cards, bank transfers, or other payment methods accepted by Lightwave Surfboards. Credit card payments will incur an additional 3% fee.
2.4 Lightwave Surfboards reserves the right to change the pricing of its manufacturing services at any time. However, such changes will not affect orders that have already been placed and fully paid for.

2.5 Full Payment is required before the collection of surfboard(s).
3. Returns and Refunds

3.1 There are no returns on custom order surfboards.
4. Ownership and Intellectual Property
4.1 The customer acknowledges that Lightwave Surfboards retains all rights, title, and interest in any proprietary information, designs, trademarks, or other intellectual property used during the manufacturing process.
4.2 The customer certifies that any designs, artwork, logos, or other materials provided by them for customisation are free from any third-party intellectual property rights infringement. The customer shall indemnify and hold Lightwave Surfboards harmless against any claims, damages, or expenses arising from the use of such materials.

5. Liability and Warranty

5.1 Surfboards are not covered under warranty due to the nature of the product and the unpredictable environment they are used in but are covered for manufacturing errors. For any issues with your surfboard please contact our team and we will be able to determine if the damage or defect is due to manufacturing or if it's caused by user damage.
5.2 The manufacturing warranty does not cover damage caused by improper handling, storage, transportation, accidents, normal wear and tear, or any modifications made by the customer or third parties.
5.3 In case of defects covered under warranty, the customer must notify Lightwave Surfboards in writing and provide supporting evidence. Lightwave Surfboards will review and assess the claim at its sole discretion and may repair, replace, or refund the defective product.
5.4 Lightwave Surfboards shall not be held liable for any indirect, incidental, special, or consequential damages arising from the customer's use or misuse of the manufactured surfboards, regardless of whether Lightwave Surfboards has been informed of the possibility of such damages.
5.5 Lightwave Surfboards will not be held responsible for any injury incurred while using our products. Use at your own risk.
6. Governing Law and Jurisdiction

6.1 These manufacturing terms and conditions shall be governed by and construed in accordance with the laws of New Zealand.
6.2 Any disputes or claims arising out of or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts located in New Zealand.
By placing an order with Lightwave Surfboards, the customer agrees to adhere to these terms and conditions. Lightwave Surfboards reserves the right to update or modify these terms and conditions at any time without prior notice. It is the customer's responsibility to review the latest version available on our website before placing an order.
7. Shipping

Estimated surfboard shipping times:
3-10 business days (NZ Only)
Shipping quote provided by freight forwarder to be issued by Lightwave Surfboards.
We do not ship to P.O. Boxes for surfboards.
We do not ship to third party addresses unless that address is known and can be verified by Lightwave Surfboards.
Customers are responsible for paying any freight charges incurred by refused shipment and unclaimed goods,
Lightwave Surfboards will make every effort to deliver on time, however we shall not be held liable for delay or lost shipment,
Customers are responsible to have someone at the delivery address to accept the delivery.
Any delivery requests must be made prior to the shipment of the order.
Cost for re-delivery attempts will be passed on to the customer if the delivery address is unattended at the time of delivery.
1-4 business days (NZ only)
We deliver our clothing and accessories using NZ Post and it can take up to 1-4 days for the parcel to reach you.
Australia and International shipping times are to be determined at time of postage.
